Terms of Service

The terms for working with me: what I build, how you pay, what happens if either of us stops, and who owns what. Plain English where the law allows it.

1. Introduction

These Terms of Service ("Terms") govern your use of baaark.com and the services offered through it ("Services"). By using the Services you agree to them. The Services are operated by MRJ (trading as baaark.com), registered in Poland (REGON 385160952, NIP PL7532455176), ul. Fabryczna 14d, 53-609 Wrocław, Poland.

2. Definitions

  • "We", "us", "our" — MRJ (trading as baaark.com)
  • "You", "your", "client" — the person or business using the Services
  • "Services" — web design, development, local SEO, social content, email marketing, hosting and support
  • "Subscription" — ongoing hosting, care-plan and support services billed monthly or annually
  • "Content" — all material created for you or supplied by you

3. Services

3.1 Design and build

  • We build to an agreed brief; the brief and the price are confirmed in writing before work starts
  • Projects need your cooperation and timely feedback
  • Deliverables are subject to your approval; approval is not unreasonably withheld

3.2 Hosting

  • Sites are hosted on the BAAARK! Sites platform (Vercel and Supabase)
  • Automated backups, TLS certificates and security monitoring are included

3.3 Support

  • Support is by email at hello@baaark.com
  • Response times depend on the plan; critical issues are handled first

4. Payment

  • Design work needs a 50% deposit before it starts; the remaining 50% is due before the finished work is delivered or goes live
  • Subscriptions are billed monthly or annually, in advance, through Stripe
  • Prices can change with 30 days' notice; a change never applies to a period you have already paid for
  • Failed payments are retried; the service may be suspended after the third failure and restored on payment

5. Refunds

Deposits are non-refundable and there are no refunds on completed custom work or on partial subscription periods. The full rules, including what happens when we cannot deliver, are in the refund policy.

6. Your obligations

  • Supply the material we need on time, with the right to use it
  • Make sure your content is lawful
  • Keep your contact details current
  • No illegal or harmful content, no attempts at unauthorised access, no disruption of the service

7. Intellectual property

  • You keep the rights to your own content and grant us a licence to use it to provide the Services
  • On final payment you own the finished design and the pages built for you
  • We keep the rights to the platform code, tooling and systems; you have a licence to use them for as long as your site runs on them
  • We may show the work in our portfolio unless you ask us not to in writing

8. Availability and liability

  • We aim for 99.9% uptime but cannot guarantee uninterrupted service; maintenance windows are announced where possible
  • We keep regular backups but are not liable for data loss beyond our control; keep copies of anything irreplaceable
  • Our total liability under these Terms is limited to the fees you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, and UK consumers keep their statutory rights

9. Privacy

We process personal data as described in the privacy policy. Where we process data on your behalf — for example the enquiries your own site receives — the data processing agreement applies.

10. Ending things

  • By you: cancel a subscription by email; it ends at the next billing date. Download your content before the account closes and settle any balance.
  • By us: for a breach of these Terms, non-payment or illegal use, or with 30 days' notice if we discontinue a service. We will help you move your site.

11. Changes to these Terms

We may update these Terms with 30 days' notice. Continuing to use the Services after that means you accept them.

12. Governing law

These Terms are governed by Polish law. UK consumers keep the rights they have under UK law. If any provision is found invalid the rest still stands.

13. Force majeure and assignment

Neither of us is liable for delays caused by events outside reasonable control. We may assign these Terms to a successor business; you may not assign them without our written permission.
